Subjektet do t\u00eb firmosin nj\u00eb<span>\u00a0<\/span><strong>kontrat\u00eb shitjeje me kusht<\/strong><span>\u00a0<\/span>me shtetin sipas t\u00eb cil\u00ebs toka b\u00ebhet e tyre kundrejt blerjes me nj\u00eb tarif\u00eb simbolike prej 1 euro, por \u00e7ertifikat\u00ebn e pron\u00ebsis\u00eb e marrin pasi t\u00eb ken\u00eb p\u00ebrfunduar nd\u00ebrtimi.<\/p>\n<\/div>\n<div class=\"author_and_related\">\n<ul class=\"single_article_related\">\n<li><a href=\"https:\/\/shqiptarja.com\/uploads\/ckeditor\/678040f592bd1Qeveria%20Shqiptare%20Keshilli%20i%20Ministrave%203.pdf\">PDF\/ Pr\/ligji i &#8216;Paketes se Maleve&#8217;<\/a><\/li>\n<li><strong>TIRANE-\u00a0<\/strong>Qeveria shqiptare miratoi m\u00eb 9 janar 2025 pr\/ligjin e ri, t\u00eb quajtur &#8220;<a href=\"https:\/\/shqiptarja.com\/tag\/138729\">Paketa e Maleve<\/a>&#8220;, i cili synon nxitjen e zhvillimit t\u00eb q\u00ebndruesh\u00ebm ekonomik n\u00eb zonat malore t\u00eb vendit. Ky\u00a0<a href=\"https:\/\/shqiptarja.com\/tag\/6738\">projektligj<\/a>, i lancuar nga Kryeministri Edi Rama pak muaj m\u00eb par\u00eb parashikon kriteret e kalimit t\u00eb pron\u00ebsis\u00eb shtet\u00ebrore tek private kundrejt blerjes me nj\u00eb tarif\u00eb simbolike prej 1 euro.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"single_article_body\">\n<p>Pr\/ligji parashikon mes poseduesit jo pronar dhe qeveris\u00eb firmosjen\u00a0e nj\u00eb kontrate shitjeje me kusht sipas t\u00eb cilit\u00a0 pronari\u00a0merr \u00e7ertifikat\u00ebn e pron\u00ebsis\u00eb vet\u00ebm pasi realizon nd\u00ebrtimin e planifikuar.\u00a0Synohet p\u00ebrdorimi i tok\u00ebs qoft\u00eb \u2018pyll\u201d, \u201ckullot\u00eb\u201d livadh p\u00ebr investime q\u00eb zhvillojn\u00eb zon\u00ebn.<\/p>\n<p>Pr\/ligji p\u00ebrcakton kriteret si \u00a0leht\u00ebsit\u00eb fiskale dhe tatimore q\u00eb ofrohen p\u00ebr subjektet q\u00eb p\u00ebrfitojn\u00eb pron\u00ebsin\u00eb mbi sip\u00ebrfaqet sipas k\u00ebtij ligji dhe realizojn\u00eb projektet e deklaruara p\u00ebr nj\u00eb periudh\u00eb 10 vje\u00e7are. Por, p\u00ebr t\u00eb p\u00ebrfituar k\u00ebto leht\u00ebsira p\/ligji ka vendosur nj\u00eb tavan: 500 subjekte<\/p>\n<p><strong>Q\u00ebllimi i ligjit<\/strong><br \/>\nSipas nenit t\u00eb par\u00eb, q\u00ebllimi i ligjit \u00ebsht\u00eb t\u00eb mb\u00ebshtes\u00eb rim\u00ebk\u00ebmbjen ekonomike dhe sociale t\u00eb zonave malore duke:<br \/>\n&#8211; T\u00ebrhequr investime p\u00ebr zhvillim t\u00eb q\u00ebndruesh\u00ebm ekonomik.<br \/>\n&#8211; Promovuar shfryt\u00ebzimin me eficienc\u00eb t\u00eb burimeve natyrore dhe mbrojtjen e ekosistemeve.<br \/>\n&#8211; P\u00ebrmir\u00ebsuar kushtet e jetes\u00ebs dhe krijuar vende pune.<br \/>\n&#8211; Mb\u00ebshtetur kalimin e pron\u00ebsis\u00eb s\u00eb pasurive shtet\u00ebrore t\u00eb p\u00ebrdorura nga privat\u00ebt pa titull pron\u00ebsie.<\/p>\n<p>Pr\/ligji parashikon kalimin e pron\u00ebsis\u00eb mbi pasurit\u00eb shtet\u00ebrore n\u00eb k\u00ebto zona, t\u00eb poseduara pa titull pron\u00ebsie prej subjekteve private, n\u00eb funksion t\u00eb zhvillimit t\u00eb tyre, p\u00ebr ushtrimin e aktiviteteve ekonomike<\/p>\n<p><strong>Si do t\u00eb funksionoj\u00eb?<\/strong><br \/>\nLigji p\u00ebrcakton procedura specifike p\u00ebr shpalljen e zonave malore si &#8220;zona prioritare zhvillimi&#8221;. Pas shpalljes, individ\u00ebt ose subjektet q\u00eb zot\u00ebrojn\u00eb pasuri shtet\u00ebrore n\u00eb k\u00ebto zona pa titull pron\u00ebsie mund t\u00eb aplikojn\u00eb p\u00ebr njohjen si &#8220;posedues jopronar\u00eb&#8221;. K\u00ebta posedues mund t\u00eb blejn\u00eb pasurin\u00eb me nj\u00eb tarif\u00eb simbolike prej 1 euro, duke synuar t&#8217;i p\u00ebrdorin p\u00ebr investime q\u00eb zhvillojn\u00eb zon\u00ebn.<\/p>\n<p><strong>Cilat zona shpallen prioritare p\u00ebr zhvillim?<\/strong><br \/>\nP\u00ebr t&#8217;u shpallur nj\u00eb zon\u00eb si prioritare p\u00ebr zhvillim, duhet t\u00eb argumentohet potenciali i saj ekonomik, industrial apo turistik. P\u00ebr t\u00eb p\u00ebrfituar si posedues, subjektet duhet t\u00eb plot\u00ebsojn\u00eb disa kritere, si:<\/p>\n<p>-Posedim i vazhduesh\u00ebm mbi pasurin\u00eb e paluajtshme shtet\u00ebrore p\u00ebr t\u00eb pakt\u00ebn 10 vjet, duke e p\u00ebrdorur at\u00eb sikur t\u00eb ishte ai pronari i saj.<br \/>\n-Pasuria t\u00eb jet\u00eb shtet\u00ebrore dhe jo publike e patjet\u00ebrsueshme.<br \/>\n-Mosprani e t\u00eb drejtave reale t\u00eb pal\u00ebve t\u00eb treta mbi pron\u00ebn.<\/p>\n<p><em>\u201cSubjekti paraqet dokumentacion provues ose q\u00eb p\u00ebrcjell informacion p\u00ebr k\u00ebt\u00eb posedim, n\u00ebse ka t\u00eb till\u00eb. Mungesa e dokumentacionit nuk pengon procedur\u00ebn administrative p\u00ebr njohjen e tij si \u201cposedues jopronar\u201d dhe merret i mir\u00ebqen\u00eb deklarimi i subjektit p\u00ebr sa koh\u00eb nuk paraqiten prova nga t\u00eb tret\u00ebt p\u00ebr t\u00eb kund\u00ebrt\u00ebn gjat\u00eb afishimit publik dhe procedurave t\u00eb p\u00ebrcaktuara n\u00eb k\u00ebt\u00eb ligj. P\u00ebr q\u00ebllime t\u00eb k\u00ebtij ligji, do t\u00eb konsiderohen posedues\u00a0 jopronar\u00eb edhe ata persona fizik\u00eb q\u00eb nuk e p\u00ebrdorin pasurin\u00eb, por v\u00ebrtetojn\u00eb lidhjen e tyre me pasurin\u00eb, p\u00ebr t\u00eb cil\u00ebn nuk jan\u00eb pajisur me titull pron\u00ebsie, sipas legjislacionit n\u00eb fuqi dhe k\u00ebrkojn\u00eb ta zhvillojn\u00eb at\u00eb n\u00ebp\u00ebrmjet nj\u00eb investimi\u201d thuhet n\u00eb pik\u00ebn \u00e7 t\u00eb nenit 3 t\u00eb k\u00ebtij pr\/ligji<\/em><\/p>\n<p><strong>Si p\u00ebrcaktohet zona e zhvillimit?<\/strong><br \/>\nMinistri p\u00ebrgjegj\u00ebs p\u00ebr pushtetin vendor, me k\u00ebrkes\u00eb t\u00eb argumentuar t\u00eb bashkis\u00eb kompetente, i propozon K\u00ebshillit t\u00eb Ministrave shpalljen e territorit t\u00eb bashkis\u00eb apo t\u00eb pjes\u00ebs malore t\u00eb atij territori si zon\u00eb zhvillimi<\/p>\n<p>Agjencia Shtet\u00ebrore e Kadastr\u00ebs fillon menj\u00ebher\u00eb procedur\u00ebn e regjistrimit fillestar t\u00eb zonave kadastrale, q\u00eb p\u00ebrfshihen n\u00eb zon\u00ebn p\u00ebr zhvillim. Kur zona i \u00ebsht\u00eb n\u00ebnshtruar m\u00eb par\u00eb regjistrimit fillestar, n\u00ebse \u00ebsht\u00eb e nevojshme, ASHK-ja kryen procedurat p\u00ebr p\u00ebrmir\u00ebsimin e regjistrit t\u00eb pasurive t\u00eb paluajtshme, sipas t\u00eb nj\u00ebjtit legjislacion.<\/p>\n<p>Rregullat dhe dokumentacioni p\u00ebr k\u00ebt\u00eb proces do t\u00eb p\u00ebrcaktohet brenda 6 muajve nga hyrja n\u00eb fuqi e k\u00ebtij projektligji.<\/p>\n<p><strong>Procedurat\/ Si b\u00ebhesh posedues jopronar\u00eb<\/strong><br \/>\nPasi nj\u00eb zon\u00eb shpallet si e p\u00ebrshtatshme p\u00ebr zhvillim, aplikimet nga poseduesit shqyrtohen nga bashkia p\u00ebrkat\u00ebse. Aplikanti paraqet k\u00ebrkes\u00ebn pran\u00eb nj\u00ebsis\u00eb s\u00eb vet\u00ebqeverisjes vendore p\u00ebr njohjen si posedues jopronar\u00eb, t\u00eb shoq\u00ebruar me plan rilevimi t\u00eb sip\u00ebrfaqes s\u00eb poseduar, t\u00eb hartuar nga nj\u00eb ekspert gjeodet i licencuar. N\u00ebse subjekti disponon dokumentacion provues t\u00eb posedimit apo q\u00eb p\u00ebrmban informacion p\u00ebr t\u00eb, ia bashk\u00eblidh at\u00eb k\u00ebrkes\u00ebs.<\/p>\n<p>Ky proces p\u00ebrfshin verifikime t\u00eb gjendjes juridike dhe posedimit t\u00eb pasuris\u00eb, me mb\u00ebshtetje nga institucionet p\u00ebrkat\u00ebse si Agjencia Shtet\u00ebrore e Kadastr\u00ebs (ASHK) dhe Agjencia e Trajtimit t\u00eb Pronave.<\/p>\n<p>N\u00eb rast se mbi nj\u00eb pron\u00eb ka pretendime nga pal\u00eb t\u00eb treta, bashkia i jep p\u00ebrpar\u00ebsi poseduesve q\u00eb p\u00ebrmbushin kriteret e p\u00ebrcaktuara nga ligji. N\u00ebse disa kushte nuk plot\u00ebsohen, poseduesi mund t\u00eb vazhdoj\u00eb procedur\u00ebn p\u00ebr pjes\u00ebn e mbetur t\u00eb pron\u00ebs.<\/p>\n<p><strong>CIlat jan\u00eb kriteret e pron\u00ebs?<\/strong><br \/>\n-T\u00eb jet\u00eb pasuri shtet\u00ebrore.<br \/>\n-T\u00eb mos jet\u00eb pron\u00eb publike e patjet\u00ebrsueshme. N\u00eb kuptim t\u00eb k\u00ebtij ligji dhe t\u00eb ligjit nr.8743, dat\u00eb 22.2.2001, t\u00eb ndryshuar, llojet e pasuris\u00eb \u201cpyll\u201d, \u201ckullot\u00eb\u201d \u201clivadh\u201d nuk jan\u00eb t\u00eb patjet\u00ebrsueshme dhe mund t\u2019u n\u00ebnshtrohen procedurave t\u00eb kalimit t\u00eb pron\u00ebsis\u00eb sipas k\u00ebtij ligji<\/p>\n<p>-Nuk i sh\u00ebrben operacionalitetit t\u00eb Forcave t\u00eb Armatosura<br \/>\n-T\u00eb mos r\u00ebndojn\u00eb mbi t\u00eb t\u00eb drejta reale t\u00eb t\u00eb tret\u00ebve<br \/>\n-T\u00eb mos jet\u00eb objekt i procedurave t\u00eb fitimit t\u00eb pron\u00ebsis\u00eb sipas ligjit nr.20\/2020<br \/>\n-T\u00eb mos jet\u00eb marr\u00eb p\u00ebr t\u00eb vendimi i kthimit ose i kompensimit fizik ish-pronar\u00ebve<\/p>\n<p><strong>Kush kryen verifikimet e pron\u00ebs?<\/strong><br \/>\nPas verifikimeve Bashkia afishon publikisht p\u00ebr 45 dit\u00eb list\u00ebn e subjekteve me sip\u00ebrfaqet respektive, p\u00ebrshkrimin e vendndodhjes s\u00eb tyre dhe shoq\u00ebrohet nga planet e rilevimit p\u00ebrkat\u00ebse. N\u00ebse ka pretendime nga pal\u00eb t\u00eb treta bashkia nis verifikimet, informon k\u00ebrkuesin p\u00ebr pretendimet dhe ndiqen hapat e tjer\u00eb procedurial\u00eb.<\/p>\n<p>Pas p\u00ebrfundimit t\u00eb afishimit bashkia harton lista e subjekteve q\u00eb k\u00ebrkojn\u00eb t\u00eb njihen si \u201cposedues jopronar\u00eb\u201d dhe plan rilevimet e sip\u00ebrfaqeve p\u00ebrkat\u00ebse, e miratohen n\u00eb k\u00ebshillin bashkiak brenda 30 dit\u00ebve. M\u00eb pas I drejtohen Kadastr\u00ebs p\u00ebr pasqyrimin e poseduesit jopronar n\u00eb kartel\u00ebn e secil\u00ebs prej pasurive.<\/p>\n<p><strong>Si merret leja p\u00ebr zhvillim?<\/strong><br \/>\nPoseduesi jopronar mund t\u00eb paraqes\u00eb nj\u00eb k\u00ebrkes\u00eb pran\u00eb Agjencis\u00eb s\u00eb Zhvillimit t\u00eb Territorit p\u00ebr t\u00eb marr\u00eb leje zhvillimi mbi t\u00eb gjith\u00eb ose nj\u00eb pjes\u00eb t\u00eb sip\u00ebrfaqes q\u00eb ai posedon.<br \/>\n-Kushti p\u00ebr pasjen e titullit t\u00eb pron\u00ebsis\u00eb nuk \u00ebsht\u00eb penges\u00eb p\u00ebr miratimin e lejes s\u00eb zhvillimit.<br \/>\n-Autoritetet shqyrtojn\u00eb k\u00ebrkes\u00ebn bazuar n\u00eb projektin paraprak t\u00eb vepr\u00ebs q\u00eb poseduesi apo investitori synon t\u00eb nd\u00ebrtoj\u00eb.<br \/>\n-Leja e zhvillimit jepet nga K\u00ebshilli Komb\u00ebtar i Territorit dhe Ujit (KKTU)<br \/>\n-N\u00ebse poseduesi jopronar merr leje zhvillimi vet\u00ebm p\u00ebr nj\u00eb pjes\u00eb t\u00eb sip\u00ebrfaqes, ai ka t\u00eb drejt\u00eb t\u00eb aplikoj\u00eb p\u00ebr leje t\u00eb tjera p\u00ebr pjes\u00ebt e mbetura<\/p>\n<p><strong>\u00c7far\u00eb \u00ebsht\u00eb kontrata me kusht?<br \/>\nBlen tok\u00ebn 1 euro, \u00e7ertifikat\u00ebn e merr pasi realizon nd\u00ebrtimin<\/strong><\/p>\n<p>N\u00eb kuad\u00ebr t\u00eb projektligjit \u00ebsht\u00eb p\u00ebrfshir\u00eb dispozita p\u00ebr lidhjen e nj\u00eb kontrate shitjeje me kusht midis ministris\u00eb p\u00ebrgjegj\u00ebse p\u00ebr Ekonomin\u00eb dhe poseduesve jopronar\u00eb me vler\u00ebn simbolike prej 1 (nj\u00eb) euro.<br \/>\nKushti i kontrat\u00ebs \u00ebsht\u00eb marrja e \u00e7ertifikat\u00ebs s\u00eb p\u00ebrdorimit nga poseduesi jopronar, pas realizimit t\u00eb nd\u00ebrtimit t\u00eb planifikuar.<br \/>\nPoseduesi duhet t\u00eb p\u00ebrmbush\u00eb detyrimet e kontrat\u00ebs, p\u00ebrfshir\u00eb fillimin e nd\u00ebrtimit brenda 3 vitee, p\u00ebr t\u00eb garantuar kalimin e pron\u00ebsis\u00eb.<br \/>\nMinistria ka t\u00eb drejt\u00eb t\u00eb zgjidh\u00eb kontrat\u00ebn n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebanshme n\u00ebse, brenda 3 vjet\u00ebve nga lidhja e saj, nuk kan\u00eb nisur ende punimet p\u00ebr nd\u00ebrtimin e vepr\u00ebs s\u00eb planifikuar.<\/p>\n<p>N\u00eb rast zgjidhjeje t\u00eb kontrat\u00ebs, ky fakt pasqyrohet n\u00eb regjistrin e pasurive t\u00eb paluajtshme, duke rikthyer sip\u00ebrfaqen n\u00eb pron\u00ebsi shtet\u00ebrore.
