Ky \u00ebsht\u00eb ligji i par\u00eb, q\u00eb Kreu i Shtetit i kthen p\u00ebr rishqyrtim qeverise se kryeministrit Edi Rama.<\/strong><\/p>\n<p>N\u00eb arsyetimet e Presidentit thuhet se\u00a0amendamentet nuk moren 84 votat sic parashikon Kushtetuta. Kujtojm\u00eb q\u00eb ligji p\u00ebr shtet\u00ebsin u miratua me 97 vota pro ne<span>\u00a0<\/span><a href=\"http:\/\/www.panorama.com.al\/pas-10-oresh-debate-kuvendi-miraton-pr-ligjin-per-shtetesine-zgjatet-edhe-afati-i-mandatit-te-komisionit-per-reformen-zgjedhore\/\">seanc\u00ebn e 21 shtatorit t\u00eb k\u00ebtij viti.<\/a><\/p>\n<p>\u201cP\u00ebr nj\u00eb ligj p\u00ebr t\u00eb cilin Kushtetuta ka parashikuar miratimin me shumic\u00eb t\u00eb cil\u00ebsuar, konkretisht 84 vota, k\u00ebto amendamente nuk e kan\u00eb marr\u00eb numrin e k\u00ebrkuar t\u00eb votave dhe nuk mund t\u00eb quhen t\u00eb miratuara.<\/p>\n<p>N\u00eb procesin e kontrollit kushtetues, konstatimi i shkeljeve procedurale, t\u00eb cilat bien ndesh me nj\u00eb dispozit\u00eb kushtetuese (shkronja \u201cb\u201d e pik\u00ebs 2 t\u00eb nenit 81 t\u00eb Kushtetut\u00ebs) \u00ebsht\u00eb shkak i vet\u00ebmjaftuesh\u00ebm p\u00ebr kthimin p\u00ebr shqyrtim t\u00eb ligjit\u201d, thuhet nder te tjera ne arsyetimet e Presidentit.<\/p>\n<p><strong>Arsyet e kthimit te ligjit<\/strong><\/p>\n<p>T\u00eb nderuar deputet\u00eb,<\/p>\n<p>Kuvendi i Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, n\u00eb seanc\u00ebn plenare t\u00eb dat\u00ebs 21.9.2023, ka miratuar nd\u00ebr t\u00eb tjera dhe ligjin nr.\u00a077\/2023 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr.113\/2020, \u201cP\u00ebr shtet\u00ebsin\u00eb\u201d\u201d. Ky ligj \u00ebsht\u00eb p\u00ebrcjell\u00eb nga Kuvendi i Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, me shkres\u00ebn nr. 2996 Prot., dat\u00eb 4.10.2023 dhe \u00ebsht\u00eb administruar n\u00eb Institucionin e Presidentit t\u00eb Republik\u00ebs, me shkres\u00ebn nr. 4126 Prot., dat\u00eb 4.10.2023.<\/p>\n<p>Presidenti i Republik\u00ebs, shqyrtoi ligjin e paraqitur p\u00ebr shpallje, duke iu referuar praktik\u00ebs dhe procedur\u00ebs parlamentare t\u00eb ndjekur p\u00ebr propozimin, shqyrtimin, miratimin e tij dhe p\u00ebrmbajtjen e dispozitave t\u00eb vet\u00eb ligjit.<\/p>\n<p>Nga vler\u00ebsimi i Kushtetueshm\u00ebris\u00eb, ligjshm\u00ebris\u00eb dhe harmonizimit me legjislacionin n\u00eb fuqi vendas dhe nd\u00ebrkomb\u00ebtar rezulton se:<\/p>\n<p>Ligji nr. 77\/2023 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr.113\/2020, \u201cP\u00ebr shtet\u00ebsin\u00eb\u201d\u201d, p\u00ebrb\u00ebhet nga 9 nene, 8 nga t\u00eb cilat ndryshojn\u00eb p\u00ebrmbajtjen e neneve t\u00eb ligjit baz\u00eb.<\/p>\n<p><em>N\u00eb praktik\u00ebn e administruar nga Institucioni i Presidentit t\u00eb Republik\u00ebs, bashk\u00eblidhur ligjit, raporti i Komisionit P\u00ebrgjegj\u00ebs i dat\u00ebs 17.7.2023 detajon vet\u00ebm ndryshimet dhe shtesat ligjore p\u00ebr 5 nene t\u00eb saj, sepse pjesa tjet\u00ebr e dispozitave jan\u00eb shtuar 24 or\u00eb p\u00ebrpara miratimit t\u00eb ligjit, m\u00eb dat\u00eb 20.9.2023, si amendamente n\u00eb seanc\u00eb t\u00eb paraqitura nga 5 deputet\u00eb propozues, n\u00eb baz\u00eb t\u00eb nenit 75, pika 4, t\u00eb Rregullores s\u00eb Kuvendit. Amendamentet u p\u00ebrfshin\u00eb n\u00eb tekstin final t\u00eb ligjit, me p\u00ebrmbajtjen si m\u00eb posht\u00eb vijojn\u00eb:<\/em><\/p>\n<p><em>Amendamenti I<\/em><\/p>\n<p>Neni 2<\/p>\n<p>N\u00eb nenin 8, \u201cFitimi i shtet\u00ebsis\u00eb me natyralizim\u201d, b\u00ebhen ndryshimet si m\u00eb posht\u00eb:<\/p>\n<p>Pika 1, shkronja \u201ce\u201d ndryshon si m\u00eb posht\u00eb:<\/p>\n<p>\u201ce) zot\u00ebron njohuri t\u00eb gjuh\u00ebs shqipe, t\u00eb folur dhe t\u00eb shkruar, si dhe njohurit\u00eb baz\u00eb t\u00eb historis\u00eb s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, t\u00eb v\u00ebrtetuar nga institucioni p\u00ebrkat\u00ebs arsimor. P\u00ebrjashtim nga ky rregull b\u00ebhet vet\u00ebm p\u00ebr shtetasit e huaj n\u00eb shtetet e t\u00eb cilave gjuha shqipe \u00ebsht\u00eb gjuh\u00eb zyrtare\u201d .<\/p>\n<p><em>Amendamenti II<\/em><\/p>\n<p>Neni 2<\/p>\n<p>Pika 3 ndryshon si m\u00eb posht\u00eb:<\/p>\n<p>\u201c3. I huaji, q\u00eb \u00ebsht\u00eb i martuar me shtetas shqiptar p\u00ebr nj\u00eb periudh\u00eb jo m\u00eb pak se 3 (tre) vjet, mund t\u00eb paraqes\u00eb k\u00ebrkes\u00eb p\u00ebr t\u00eb fituar shtet\u00ebsin\u00eb me natyralizim edhe n\u00ebse nuk plot\u00ebson kushtet e p\u00ebrcaktuara n\u00eb shkronjat \u201cc\u201d dhe \u201ce\u201d t\u00eb pik\u00ebs 1 t\u00eb k\u00ebtij neni, n\u00ebse ka banuar n\u00eb m\u00ebnyr\u00eb t\u00eb ligjshme dhe t\u00eb vazhdueshme n\u00eb territorin e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb t\u00eb pakt\u00ebn p\u00ebr 1 (nj\u00eb) vit gjat\u00eb gjith\u00eb periudh\u00ebs s\u00eb martes\u00ebs\u201d.<\/p>\n<p><em>Amendamenti III<\/em><\/p>\n<p>N\u00eb nenin 11 t\u00eb ligjit, \u201cFitimi i shtet\u00ebsis\u00eb nga refugjat\u00ebt apo nga personat n\u00eb mbrojtje plot\u00ebsuese\u201d, b\u00ebhen ndryshimet si m\u00eb posht\u00eb:<\/p>\n<p>N\u00eb pik\u00ebn 1, shkronjat \u201cdh\u201d dhe \u201ce\u201d ndryshojn\u00eb si m\u00eb posht\u00eb:<\/p>\n<p>\u201cdh) nuk ka qen\u00eb i d\u00ebnuar me vendim gjyq\u00ebsor t\u00eb form\u00ebs s\u00eb prer\u00eb n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb ose n\u00eb ndonj\u00eb shtet t\u00eb tret\u00eb p\u00ebr veprat penale p\u00ebr t\u00eb cilat ligji shqiptar parashikon d\u00ebnime me jo m\u00eb pak se 3 (tre) vjet heqje lirie, me p\u00ebrjashtim t\u00eb rasteve kur v\u00ebrtetohet se d\u00ebnimi \u00ebsht\u00eb dh\u00ebn\u00eb p\u00ebr motive politike.<\/p>\n<ol>\n<li>e) zot\u00ebron njohuri t\u00eb gjuh\u00ebs shqipe, t\u00eb folur e t\u00eb shkruar, njohurit\u00eb baz\u00eb t\u00eb historis\u00eb e t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, t\u00eb v\u00ebrtetuar nga institucioni p\u00ebrkat\u00ebs arsimor\u201d.<\/li>\n<\/ol>\n<p><em>Amendamenti IV<\/em><\/p>\n<p>N\u00eb nenin 17 t\u00eb ligjit, \u201cParaqitja e k\u00ebrkes\u00ebs\u201d, b\u00ebhen ndryshimet si m\u00eb posht\u00eb:<\/p>\n<p>Pika 1 ndryshon si m\u00eb posht\u00eb:<\/p>\n<p>\u201c1. K\u00ebrkesa drejtuar Presidentit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb p\u00ebr fitimin, rifitimin dhe heqjen dor\u00eb nga shtet\u00ebsia shqiptare dhe dokumentacioni i k\u00ebrkuar sipas k\u00ebtij ligji depozitohen online n\u00ebp\u00ebrmjet platform\u00ebs elektronike \u201ce-albania\u201d.<\/p>\n<p>Pika 2 ndryshon si m\u00eb posht\u00eb:<\/p>\n<p>\u201c2. Rregullat e detajuara p\u00ebr dokumentacionin e nevojsh\u00ebm, form\u00ebn dhe m\u00ebnyr\u00ebn e plot\u00ebsimit t\u00eb k\u00ebrkes\u00ebs sipas k\u00ebtij neni, miratohen me udh\u00ebzim t\u00eb p\u00ebrbashk\u00ebt t\u00eb ministrit p\u00ebrgjegj\u00ebs p\u00ebr \u00e7\u00ebshtjet e rendit dhe siguris\u00eb publike dhe ministrit p\u00ebrgjegj\u00ebs p\u00ebr pun\u00ebt e jashtme\u201d.<\/p>\n<p><em>Amendamenti V<\/em><\/p>\n<p>Pas nenit 19 t\u00eb ligjit shtohet neni 19\/1 me k\u00ebt\u00eb p\u00ebrmbajtje:<\/p>\n<p>Neni 19\/1<\/p>\n<p>\u201cE drejta p\u00ebr rishikim<\/p>\n<p>Akti administrativ, i cili vendos mospranimin e k\u00ebrkes\u00ebs p\u00ebr fitimin, rifitimin apo heqjen dor\u00eb nga shtet\u00ebsia shqiptare, mund t\u00eb ankimohet pran\u00eb gjykat\u00ebs administrative t\u00eb shkall\u00ebs s\u00eb par\u00eb Tiran\u00eb n\u00eb p\u00ebrputhje me legjislacionin p\u00ebrkat\u00ebs n\u00eb fuqi\u201d.<\/p>\n<p><strong>N\u00eb analiz\u00eb t\u00eb Kushtetueshm\u00ebris\u00eb,<\/strong><span>\u00a0<\/span>shtesat dhe ndryshimet ligjore t\u00eb p\u00ebrcjella p\u00ebr shpallje, jan\u00eb pjes\u00eb e ligjit nr.77\/2023 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 113\/2020, \u201cP\u00ebr shtet\u00ebsin\u00eb\u201d\u201d, q\u00eb sipas nenit 81, pika 2, shkronja \u201cb\u201d t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, miratohet me shumic\u00eb t\u00eb cil\u00ebsuar prej 3\/5 t\u00eb t\u00eb gjith\u00eb an\u00ebtar\u00ebve t\u00eb Kuvendit, minimalisht 84 vota.<\/p>\n<p>Nga procesverbali i seanc\u00ebs plenare t\u00eb dat\u00ebs 21.9.2023 dhe t\u00eb dh\u00ebnave t\u00eb votimit elektronik konstatohet se miratimi i amendamentit t\u00eb dyt\u00eb \u00ebsht\u00eb b\u00ebr\u00eb me 78 vota, i amendamentit t\u00eb tret\u00eb me 77 vota, i amendamentit t\u00eb kat\u00ebrt me 78 vota dhe i amendamentit t\u00eb pest\u00eb me 79 vota.<\/p>\n<p><strong>P\u00ebr nj\u00eb ligj p\u00ebr t\u00eb cilin Kushtetuta ka parashikuar miratimin me shumic\u00eb t\u00eb cil\u00ebsuar, konkretisht 84 vota, k\u00ebto amendamente nuk e kan\u00eb marr\u00eb numrin e k\u00ebrkuar t\u00eb votave dhe nuk mund t\u00eb quhen t\u00eb miratuara.<\/strong><\/p>\n<p>Kushtetuta n\u00eb nenin 78 p\u00ebrcakton se:<span>\u00a0<\/span><em>\u201cKuvendi vendos me shumic\u00ebn e votave, n\u00eb prani t\u00eb m\u00eb shum\u00eb se gjysm\u00ebs s\u00eb t\u00eb gjith\u00eb an\u00ebtar\u00ebve t\u00eb tij, p\u00ebrve\u00e7 rasteve kur Kushtetuta parashikon nj\u00eb shumic\u00eb t\u00eb cil\u00ebsuar<\/em>\u201d, sikurse p\u00ebrcakton n\u00eb pik\u00ebn 1 t\u00eb nenit 83 se \u201c<em>projektligji votohet tri her\u00eb: n\u00eb parim, nen p\u00ebr nen dhe n\u00eb t\u00ebr\u00ebsi<\/em>\u201d.<\/p>\n<p>Analiza e k\u00ebtyre dispozitave \u00e7on n\u00eb m\u00ebnyr\u00eb t\u00eb pashmangshme n\u00eb konkluzionin se shumica e cil\u00ebsuar \u00ebsht\u00eb k\u00ebrkes\u00eb, s\u00eb cil\u00ebs i n\u00ebnshtrohen t\u00eb tre komponent\u00ebt e votimit, si votimi n\u00eb parim ashtu dhe votimi nen p\u00ebr nen dhe ai n\u00eb t\u00ebr\u00ebsi.<\/p>\n<p><strong>N\u00eb procesin e kontrollit kushtetues, konstatimi i shkeljeve procedurale, t\u00eb cilat bien ndesh me nj\u00eb dispozit\u00eb kushtetuese (shkronja \u201cb\u201d e pik\u00ebs 2 t\u00eb nenit 81 t\u00eb Kushtetut\u00ebs) \u00ebsht\u00eb shkak i vet\u00ebmjaftuesh\u00ebm p\u00ebr kthimin p\u00ebr shqyrtim t\u00eb ligjit.<\/strong><\/p>\n<p><strong>Vler\u00ebsimi p\u00ebr ligjin<\/strong>:<\/p>\n<p>P\u00ebr nga p\u00ebrmbajtja dispozitat e reja nuk bien n\u00eb kund\u00ebrshtim me dispozita substanciale t\u00eb Kushtetut\u00ebs. Dispozitat e ligjit kryesisht krijojn\u00eb leht\u00ebsira p\u00ebr marrjen e shtet\u00ebsis\u00eb shqiptare, masa dhe lloji i t\u00eb cilave \u00ebsht\u00eb n\u00eb gjykimin sovran t\u00eb Kuvendit.<\/p>\n<p>Gjithsesi, k\u00ebto leht\u00ebsira vlen t\u00eb analizohen edhe n\u00eb kontekstin e Konvent\u00ebs Evropiane p\u00ebr shtet\u00ebsin\u00eb, e cila \u00ebsht\u00eb konvent\u00eb e K\u00ebshillit t\u00eb Evrop\u00ebs, si dhe n\u00eb kontekstin e raportit q\u00eb krijojn\u00eb<span>\u00a0<\/span><em>me parimin e barazis\u00eb para ligjit.<\/em><\/p>\n<p>Konventa Evropiane p\u00ebr Shtet\u00ebsin\u00eb, e dat\u00ebs 06.11.1997, e cila \u00ebsht\u00eb ratifikuar nga Republika e Shqip\u00ebris\u00eb me ligjin nr.8942, dat\u00eb 19.9.2002, duhet t\u00eb formoj\u00eb konturin kushtetues mbi t\u00eb cilin ligji p\u00ebr shtet\u00ebsin\u00eb normon kushtet dhe kriteret p\u00ebr marrjen ose l\u00ebnien e shtet\u00ebsis\u00eb shqiptare. Pika 2 e nenit 122 t\u00eb Kushtetut\u00ebs parashikon se \u201c<em>nj\u00eb marr\u00ebveshje nd\u00ebrkomb\u00ebtare e ratifikuar me ligj ka ep\u00ebrsi mbi ligjet e vendit q\u00eb nuk pajtohen me t\u00eb<\/em>\u201d.<\/p>\n<p>Prandaj n\u00eb procesin e kontrollit kushtetues q\u00eb i paraprin shpalljes s\u00eb ligjit ka vend p\u00ebr t\u00eb konfrontuar dispozitat e reja me kufijt\u00eb e vendosur nga Konventa Evropiane p\u00ebr Shtet\u00ebsin\u00eb.<\/p>\n<p>Konventa p\u00ebrcakton n\u00eb nenin 6:<\/p>\n<ul>\n<li>fitimin<span>\u00a0<\/span><em>ex lege<\/em><span>\u00a0<\/span>t\u00eb shtet\u00ebsis\u00eb p\u00ebr shkak t\u00eb lidhjes s\u00eb gjakut (p\u00ebr ne, f\u00ebmij\u00ebt e lindur nga shtetas shqiptar\u00eb jan\u00eb shtetas shqiptar\u00eb. N\u00eb k\u00ebt\u00eb kategori futen edhe f\u00ebmij\u00ebt e gjetur n\u00eb territorin e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, p\u00ebr shkak t\u00eb prezumimit se jan\u00eb f\u00ebmij\u00eb t\u00eb lindur nga shtetas shqiptar\u00eb);<\/li>\n<li>fitimin<span>\u00a0<\/span><em>ex lege<\/em><span>\u00a0<\/span>ose me k\u00ebrkes\u00eb t\u00eb shtet\u00ebsis\u00eb p\u00ebr shkak t\u00eb lidhjes me territorin vet\u00ebm p\u00ebr f\u00ebmij\u00ebt e lindur brenda territorit, t\u00eb cil\u00ebt, n\u00eb rast se nuk marrin shtet\u00ebsin\u00eb e shtetit ku kan\u00eb lindur, do duhet t\u00eb mbeteshin pa shtet\u00ebsi;<\/li>\n<li>fitimin e shtet\u00ebsis\u00eb me natyralizim p\u00ebr personat q\u00eb jan\u00eb rezident\u00eb, n\u00eb m\u00ebnyr\u00eb t\u00eb ligjshme dhe t\u00eb vazhdueshme n\u00eb shtetin, shtet\u00ebsin\u00eb e t\u00eb cilit k\u00ebrkojn\u00eb t\u00eb marrin me kushtin q\u00eb shtetet aderuese n\u00eb Konvent\u00eb t\u00eb mos parashikojn\u00eb periudha rezidence t\u00eb detyrueshme m\u00eb t\u00eb gjata se sa dhjet\u00eb vjet nga momenti i aplikimit.<\/li>\n<\/ul>\n<p>Pika 4 e nenit 6 t\u00eb Konvent\u00ebs ka vendosur shtetet aderuese n\u00eb t\u00eb, p\u00ebrpara detyrimit q\u00eb t\u00eb leht\u00ebsojn\u00eb n\u00eb ligjet e tyre marrjen e shtet\u00ebsis\u00eb p\u00ebr:<\/p>\n<ol>\n<li>bashk\u00ebshort\u00ebt e shtetasve t\u00eb tyre;<\/li>\n<li>f\u00ebmij\u00ebt e ndonj\u00ebrit nga shtetasit e shtetit aderues, t\u00eb cil\u00ebt kan\u00eb lindur jasht\u00eb territorit dhe, p\u00ebr k\u00ebt\u00eb shkak, nuk kan\u00eb mundur t\u00eb marrin shtet\u00ebsin\u00eb n\u00eb lindje (kur ligji nuk e lejon marrjen e shtet\u00ebsis\u00eb s\u00eb prind\u00ebrve kur f\u00ebmija lind jasht\u00eb territorit);<\/li>\n<li>f\u00ebmij\u00ebt, nj\u00ebri prind i t\u00eb cil\u00ebve merr ose ka marr\u00eb shtet\u00ebsin\u00eb e k\u00ebtij shteti;<\/li>\n<li>f\u00ebmij\u00ebt e bir\u00ebsuar nga nj\u00eb shtetas i tij;<\/li>\n<li>personat e lindur n\u00eb territorin e shtetit dhe q\u00ebndrojn\u00eb aty ligj\u00ebrisht dhe n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme;<\/li>\n<li>personat q\u00eb q\u00ebndrojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb ligjshme dhe t\u00eb vazhdueshme n\u00eb territorin e shtetit p\u00ebr nj\u00eb periudh\u00eb kohe, e cila ka filluar para se t\u00eb mbushin mosh\u00ebn 18 vje\u00e7, periudh\u00eb e cila duhet t\u00eb p\u00ebrcaktohet nga ligji i brendsh\u00ebm i shtetit n\u00eb fjal\u00eb;<\/li>\n<li>personat pa shtet\u00ebsi dhe refugjat\u00eb t\u00eb njohur, q\u00eb q\u00ebndrojn\u00eb ligj\u00ebrisht dhe n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme n\u00eb territorin e tij.<\/li>\n<\/ol>\n<p>Ligji nr. 77\/2023 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr. 113\/2020 \u201cP\u00ebr shtet\u00ebsin\u00eb\u201d\u201d, ka pasur q\u00ebllim vendosjen e nj\u00eb numri leht\u00ebsish p\u00ebr kategori t\u00eb caktuara personash. Nga kategorit\u00eb e p\u00ebrfshira n\u00eb t\u00eb nuk gjejn\u00eb mb\u00ebshtetje n\u00eb dispozitat e Konvent\u00ebs:<\/p>\n<ol>\n<li>Neni 1 i ligjit nr.77\/2023 parashikon se<em>, nj\u00eb f\u00ebmij\u00eb i lindur brenda territorit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb nga prind\u00ebr me shtet\u00ebsi tjet\u00ebr, t\u00eb cil\u00ebt q\u00ebndrojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb ligjshme n\u00eb territorin e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, mund t\u00eb marr\u00eb shtet\u00ebsi shqiptare me p\u00eblqimin e t\u00eb dy prind\u00ebrve<\/em>. Kjo kategori e ka referenc\u00ebn tek shkronja \u201ce\u201d e pik\u00ebs 4 t\u00eb nenit 6 t\u00eb konvent\u00ebs, por dispozita referuese k\u00ebrkon rezidenc\u00eb t\u00eb ligjshme dhe t\u00eb vazhdueshme dhe k\u00ebt\u00eb nuk e k\u00ebrkon p\u00ebr prind\u00ebrit, por p\u00ebr subjektin e t\u00eb drejt\u00ebs (f\u00ebmij\u00ebn). Dispozita do ishte e pajtueshme me konvent\u00ebn n\u00ebse do parashikonte nj\u00eb afat rezidence t\u00eb ligjshme dhe t\u00eb vazhdueshme p\u00ebr vet\u00eb f\u00ebmij\u00ebn.<\/li>\n<li>Paragrafi i dyt\u00eb i nenit 2 t\u00eb ligjit nr.77\/2023, q\u00eb ndryshon pik\u00ebn 3 t\u00eb nenit 8 t\u00eb ligjit nr. 113\/2020, parashikon se,<span>\u00a0<\/span><em>i huaji, q\u00eb \u00ebsht\u00eb i martuar me shtetas shqiptar p\u00ebr nj\u00eb periudh\u00eb jo m\u00eb pak se 3 (tre) vjet, mund t\u00eb paraqes\u00eb k\u00ebrkes\u00eb p\u00ebr t\u00eb fituar shtet\u00ebsin\u00eb me natyralizim edhe n\u00ebse nuk plot\u00ebson kushtet e p\u00ebrcaktuara n\u00eb shkronjat \u201cc\u201d dhe \u201ce\u201d t\u00eb pik\u00ebs 1 t\u00eb k\u00ebtij neni, n\u00ebse ka banuar n\u00eb m\u00ebnyr\u00eb t\u00eb ligjshme dhe t\u00eb vazhdueshme n\u00eb territorin e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb t\u00eb pakt\u00ebn p\u00ebr 1 (nj\u00eb) vit gjat\u00eb gjith\u00eb periudh\u00ebs s\u00eb martes\u00ebs.<\/em><span>\u00a0<\/span>Sipas pik\u00ebs 3 t\u00eb nenit 6 t\u00eb Konvent\u00ebs, natyralizimi ka lidhje me rezidenc\u00ebn e ligjshme dhe t\u00eb vazhdueshme p\u00ebr nj\u00eb periudh\u00eb t\u00eb caktuar nga momenti i aplikimit. Konventa nuk i kund\u00ebrvihet afatit t\u00eb shkurt\u00ebr nj\u00eb vje\u00e7ar t\u00eb parashikuar nga dispozita, por ky afat duhet t\u00eb p\u00ebrllogaritet nga momenti i aplikimit dhe jo si nj\u00eb periudh\u00eb \u00e7far\u00ebdo gjat\u00eb martes\u00ebs.<\/li>\n<\/ol>\n<p>Fitimi i shtet\u00ebsis\u00eb me natyralizim sipas Konvent\u00ebs<span>\u00a0<\/span><strong>ka kusht t\u00eb detyruesh\u00ebm q\u00ebndrimin n\u00eb m\u00ebnyr\u00eb t\u00eb ligjshme dhe t\u00eb vazhdueshme p\u00ebr nj\u00eb periudh\u00eb t\u00eb caktuar p\u00ebrpara depozitimit t\u00eb aplikimit<\/strong>. Koh\u00ebzgjatja e periudh\u00ebs s\u00eb rezidenc\u00ebs varet nga vullneti i ligjv\u00ebn\u00ebsit. Konventa, nga ana e saj, k\u00ebrkon vet\u00ebm q\u00eb kjo koh\u00ebzgjatje t\u00eb mos jet\u00eb m\u00eb e madhe se dhjet\u00eb vjet.<\/p>\n<p>Nj\u00eb num\u00ebr dispozitash t\u00eb ligjit nr.113\/2020 dhe t\u00eb ligjit nr.77\/2023 e kan\u00eb zbutur k\u00ebt\u00eb kusht, disa e kan\u00eb hequr fare at\u00eb. Vendosja e diskriminimit pozitiv p\u00ebr kategori t\u00eb caktuara p\u00ebrfituesish \u00ebsht\u00eb kushtetuese, sa koh\u00eb q\u00eb rasti p\u00ebrjashtimor justifikohet me interesa madhore publike, por e humbet kushtetutshm\u00ebrin\u00eb n\u00ebse kategorit\u00eb e subjekteve t\u00eb privilegjuara rriten n\u00eb m\u00ebnyr\u00eb t\u00eb pap\u00ebrligjur dhe n\u00ebse numri i pritsh\u00ebm i personave t\u00eb p\u00ebrfshir\u00eb n\u00eb to b\u00ebhet konkurueshm\u00ebrisht i lart\u00eb me numrin e personave q\u00eb<span>\u00a0<\/span><em>de facto<\/em><span>\u00a0<\/span>i n\u00ebnshtrohen kushteve dhe kritereve baz\u00eb.<\/p>\n<p>N\u00eb k\u00ebt\u00eb faz\u00eb nuk \u00ebsht\u00eb e mundur q\u00eb k\u00ebto dispozita t\u00eb analizohen n\u00eb raport me impaktin q\u00eb ato shkaktojn\u00eb mbi zbatimin e parimit t\u00eb barazis\u00eb p\u00ebrpara ligjit, p\u00ebr pasoj\u00eb t\u00eb vler\u00ebsohet n\u00ebse ato formojn\u00eb antikushtetueshm\u00ebri, apo jo. K\u00ebto dispozita nuk shprehin ende vullnetin e Kuvendit, sepse nuk kan\u00eb marr\u00eb numrin e k\u00ebrkuar t\u00eb votave.<\/p>\n<p>Interesi kushtetues e k\u00ebrkon q\u00eb Kuvendi t\u00eb marri n\u00eb konsiderat\u00eb riskun q\u00eb mbartin k\u00ebto dispozita n\u00eb raport me p\u00ebrputhshm\u00ebrin\u00eb e tyre me Konvent\u00ebn Evropiane p\u00ebr Shtet\u00ebsin\u00eb dhe t\u00eb vler\u00ebsoj\u00eb me seriozitet rishqyrtimin dhe vler\u00ebsimin e tyre n\u00eb Komisionet p\u00ebrgjegj\u00ebse Parlamentare.<\/p>\n<p>Vlen t\u00eb theksohet se respektimi i kritereve formale dhe materiale q\u00eb vendos Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, gjat\u00eb procedur\u00ebs ligjv\u00ebn\u00ebse p\u00ebrb\u00ebn nj\u00eb domosdoshm\u00ebri n\u00eb shtetin e s\u00eb drejt\u00ebs. N\u00eb rastet kur Kushtetuta, p\u00ebrcakton drejtp\u00ebrdrejt m\u00ebnyr\u00ebn e miratimit t\u00eb ligjeve me shumic\u00eb t\u00eb cil\u00ebsuar p\u00ebrcaktuar n\u00eb pik\u00ebn 2 , shkronja b) e nenit 81 t\u00eb saj, norma p\u00ebrb\u00ebn nj\u00eb proces detyrues p\u00ebr Kuvendin dhe shumica e cil\u00ebsuar n\u00eb vendimmarrje, ju jep k\u00ebtyre ligjeve nj\u00eb fuqi juridike t\u00eb ve\u00e7ant\u00eb n\u00eb raport me ligjet e zakonshme t\u00eb Kuvendit.<\/p>\n<p>Bazuar n\u00eb vler\u00ebsimin e m\u00ebsip\u00ebrm, rezulton se kat\u00ebr nga pes\u00eb amendamentet e propozuara nga grupi i deputet\u00ebve, n\u00eb projektligjin \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr.113\/2020 \u201cP\u00ebr shtet\u00ebsin\u00eb\u201d p\u00ebrcjell\u00eb Kryetares s\u00eb Kuvendit me shkres\u00eb nr. 2810 prot., dat\u00eb 20.9.2023,<span>\u00a0<\/span><strong>nuk kan\u00eb marr\u00eb votat e nevojshme p\u00ebr t\u00eb krijuar shumic\u00ebn e cil\u00ebsuar prej tri t\u00eb pestave t\u00eb t\u00eb gjith\u00eb an\u00ebtar\u00ebve t\u00eb Kuvendit<\/strong>. Ky fakt e b\u00ebn ligjin nr. 77\/2023 \u201cP\u00ebr disa shtesa dhe ndryshime n\u00eb ligjin nr.113\/2020 \u201cP\u00ebr shtet\u00ebsin\u00eb\u201d, antikushtetues p\u00ebr shkak se nj\u00eb num\u00ebr dispozitash t\u00eb tij nuk jan\u00eb miratuar n\u00eb p\u00ebrputhje me k\u00ebrkesat e sanksionuara nga pika 2, shkronja b) e nenit 81 dhe pika 1 e nenit 83 t\u00eb Kushtetut\u00ebs t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.
