Bushati sqaron pun\u00ebn voluminoze t\u00eb b\u00ebr\u00eb nga ekipi negociator, administrimin e dosjes me mbi 120 dokumente studimore, analiza dhe fakte. Sipas tij, ka qen\u00eb pik\u00ebrisht takimi i Kryeministrave Rama-Samaras n\u00eb Samitin e Wales t\u00eb cil\u00ebt dakord\u00ebsuan ngritjen e mekanizimit dypal\u00ebsh p\u00ebr adresimin e c\u00ebshtjeve t\u00eb pazgjidhura mes dy vendeve. Nd\u00ebrsa sot, kur pal\u00ebt kan\u00eb r\u00ebn\u00eb dakort t\u00eb shkojn\u00eb n\u00eb nj\u00eb Gjykat\u00eb Nd\u00ebrkombare, Bushati thot\u00eb se ky \u00ebsht\u00eb \u201cproces impenjativ q\u00eb k\u00ebrkon dije, p\u00ebrgatitje serioze dhe koh\u00ebn e duhur\u201d.<\/p>\n<p>P\u00ebr ish-ministrin e Jasht\u00ebm \u00ebsht\u00eb \u201cI dhimbsh\u00ebm fakti se pavar\u00ebsisht p\u00ebrpjekjeve disavje\u00e7are q\u00eb \u00e7\u00ebshtja e delimitimit t\u00eb hap\u00ebsir\u00ebs detare t\u00eb mbetej n\u00eb nivel dypal\u00ebsh, p\u00ebr her\u00eb t\u00eb par\u00eb, m\u00ebnyra e zgjidhjes s\u00eb k\u00ebsaj \u00e7\u00ebshtje dypal\u00ebshe p\u00ebrfshihet n\u00eb projekt dokumentin e Kuadrit Negociues q\u00eb do t\u00eb udh\u00ebheq procesin e bisedimeve t\u00eb an\u00ebtar\u00ebsimit t\u00eb Shqip\u00ebris\u00eb n\u00eb Bashkimin Europian\u201d.<\/p>\n<p>N\u00eb k\u00ebt\u00eb shkrim ai ndalet edhe tek vendimi p\u00ebr t\u00eb shkuar n\u00eb nj\u00eb gjykat\u00eb nd\u00ebrkomb\u00ebtare p\u00ebr zgjidhjen e \u00e7\u00ebshtjes s\u00eb detit p\u00ebr t\u00eb cil\u00ebn thot\u00eb se ky \u00ebsht\u00eb proces impenjativ q\u00eb k\u00ebrkon dije, p\u00ebrgatitje serioze dhe koh\u00ebn e duhur.<\/p>\n<p>\u201cPara nisjes s\u00eb procesit gjyq\u00ebsor, Shqip\u00ebria dhe Greqia do t\u00eb duhet t\u00eb p\u00ebrfshihen s\u00ebrish n\u00eb nj\u00eb proces nd\u00ebrveprues nga i cili duhet t\u00eb hartojn\u00eb nj\u00eb dokument t\u00eb p\u00ebrbashk\u00ebt p\u00ebr l\u00ebnd\u00ebn q\u00eb do t\u2019i n\u00ebnshtrohet gjykimit, ku duhet t\u00eb evidentohen gjithashtu pikat e p\u00ebrbashk\u00ebta dhe diferencat mes pal\u00ebve, p\u00ebr t\u00eb cilat duhet t\u00eb shprehet gjykata\u201d, shkruan ai.<\/p>\n<p>Bushati sjell n\u00eb v\u00ebmendje t\u00eb gjith\u00eb arritjet e ekipit negociator si: \u201cZgjidh\u00ebm \u00e7\u00ebshtjen e toponimeve duke eliminuar pengesat n\u00eb l\u00ebvizjet nd\u00ebrkufitare t\u00eb shtetasve tan\u00eb. Greqia hoqi rezerv\u00ebn p\u00ebr p\u00ebrdorimin e vul\u00ebs apostile, duke i kursyer xhepave t\u00eb shtetasve tan\u00eb rreth 5 milion euro n\u00eb vit p\u00ebr dokumente t\u00eb ndryshme. Heqja e rezerv\u00ebs p\u00ebr vul\u00ebn apostile i hap rrug\u00eb dhe l\u00ebshimit t\u00eb \u00e7ertifikatave nga zyrat tona konsullore n\u00eb Greqi, \u00e7ka do t\u00eb p\u00ebrb\u00ebnte nj\u00eb leht\u00ebsim t\u00eb madh p\u00ebr shtetasit tan\u00eb.<\/p>\n<p>Rreth 150 mij\u00eb shtetas shqiptar p\u00ebrfituan nga zgjidhja e problematik\u00ebs s\u00eb regjistrimit t\u00eb f\u00ebmij\u00ebve t\u00eb lindur n\u00eb Greqi nga nj\u00eb ose t\u00eb dy prind\u00ebrit q\u00eb nuk kan\u00eb leje q\u00ebndrimi n\u00eb Greqi. U njoh\u00ebn lejet e drejtimit t\u00eb automjeteve. Rreth 800 euro i kushtonte shtetasve shqiptar n\u00eb Greqi procedura e njohjes s\u00eb patent\u00ebs. Rinis\u00ebm pun\u00ebn p\u00ebr rishikimin e teksteve shkollore, bazuar mbi marr\u00ebveshjen e vitit 1998, duke shk\u00ebmbyer raporte mbi gjetjet n\u00eb tekstet respektive p\u00ebr \u00e7\u00ebshtjet q\u00eb p\u00ebrb\u00ebjn\u00eb shqet\u00ebsim p\u00ebr secil\u00ebn pal\u00eb\u201d.<\/p>\n<p>Shkrimi i plot\u00eb:<\/p>\n<p>Winston Churchill thoshte se n\u00eb politik\u00eb t\u00eb jashtme orientohem gjithnj\u00eb nga deti. Ai duhet shoq\u00ebruar me disiplin\u00eb strategjike e atdhedashuri, sepse deti \u00ebsht\u00eb e mir\u00eb e p\u00ebrbashk\u00ebt q\u00eb sjell zhvillim, p\u00ebrve\u00e7se ep\u00ebrsi n\u00eb ushtrimin e politik\u00ebs s\u00eb jashtme.<\/p>\n<p>Gjat\u00eb periudh\u00ebs s\u00eb izolimit komunist, vija jon\u00eb bregdetare ishte e pashfryt\u00ebzuar, nd\u00ebrkoh\u00eb q\u00eb rrethanat gjeopolitike dhe ndarja n\u00eb blloqe e Europ\u00ebs, shoq\u00ebroheshin me veprime paranojake. Megjith\u00ebk\u00ebt\u00eb, n\u00eb periudh\u00ebn e fundit t\u00eb komunizmit, kriteret e p\u00ebrcaktuara nga e drejta nd\u00ebrkomb\u00ebtare e detit p\u00ebr hap\u00ebsirat detare u respektuan. Kjo u diktua nga progresi q\u00eb njohu e drejta nd\u00ebrkomb\u00ebtare e detit me miratimin e Konvent\u00ebs s\u00eb Montego Bay n\u00eb vitin 1982. N\u00eb arkivin e Ministris\u00eb s\u00eb Pun\u00ebve t\u00eb Jashtme ka analiza profesionale, jasht\u00eb ndikimit ideologjik, q\u00eb d\u00ebshmojn\u00eb r\u00ebnd\u00ebsin\u00eb q\u00eb Shqip\u00ebria e izoluar u kushtonte k\u00ebtyre zhvillimeve nd\u00ebrkomb\u00ebtare, p\u00ebr shkak t\u00eb p\u00ebrkat\u00ebsis\u00eb s\u00eb saj n\u00eb Mesdhe.<\/p>\n<p>30 vjet m\u00eb pas, me dhimbje konstatojm\u00eb se nj\u00eb pjes\u00eb e mir\u00eb e vij\u00ebs bregdetare \u00ebsht\u00eb shkat\u00ebrruar, si pasoj\u00eb e kombinimit t\u00eb munges\u00ebs s\u00eb vizionit zhvillimor me gryk\u00ebsin\u00eb e pandalshme t\u00eb kapitalizmit grabitqar. 30 vjet m\u00eb pas, ende nuk jemi n\u00eb gjendje t\u00eb tregojm\u00eb nj\u00eb investim serioz q\u00eb t\u00eb ket\u00eb prodhuar efekte n\u00eb t\u00eb gjith\u00eb zinxhirin e vlerave t\u00eb ekonomis\u00eb, t\u00eb cilat burojn\u00eb prej detit, qoft\u00eb edhe n\u00eb nj\u00eb cop\u00ebz t\u00eb rivier\u00ebs son\u00eb. Mir\u00ebpo, sa her\u00eb q\u00eb diskutohet p\u00ebr \u00e7\u00ebshtjet e hap\u00ebsirave detare me fqinj\u00ebt, shp\u00ebrthen furia e hipokrizis\u00eb, duke na kujtuar th\u00ebnien e Goethe: \u201cAi q\u00eb vepron, \u00ebsht\u00eb gjithmon\u00eb i padrejt\u00eb. I vetmi q\u00eb \u00ebsht\u00eb i drejt\u00eb, \u00ebsht\u00eb ai q\u00eb v\u00ebzhgon\u201d.<\/p>\n<p>Ndon\u00ebse p\u00ebrball\u00eb nesh gjeografikisht \u00ebsht\u00eb Italia e n\u00eb dy krah\u00ebt tan\u00eb kemi Greqin\u00eb dhe Malin e Zi, n\u00eb sh\u00ebnjest\u00ebr \u00ebsht\u00eb gjithnj\u00eb procesi i delimitimit t\u00eb hap\u00ebsirave me Greqin\u00eb, tipar i stilit ballkanik t\u00eb nj\u00eb marr\u00ebdh\u00ebnieje dashuriurrejtje. Deri m\u00eb sot mungojn\u00eb diskutimet publike p\u00ebr t\u00eb nxitur mbylljen e procesit t\u00eb gjysm\u00ebp\u00ebrfunduar me Italin\u00eb q\u00eb nga koha e komunizmit apo p\u00ebr t\u00eb nisur procesin e delimitimit me Malin e Zi.<\/p>\n<ol>\n<li>A duhet t\u00eb p\u00ebrfshihet Shqip\u00ebria n\u00eb nj\u00eb proces delimitimi me Greqin\u00eb? E shtroj k\u00ebt\u00eb pyetje jo sepse kam ndonj\u00eb dilem\u00eb, por ngaq\u00eb nuk kan\u00eb munguar z\u00ebrat publik\u00eb, q\u00eb pretendojn\u00eb se \u00e7\u00ebshtja e detit \u00ebsht\u00eb e stisur dhe se ajo \u00ebsht\u00eb ezauruar me Protokollin e Firences t\u00eb vitit 1925.<\/li>\n<li>Shqip\u00ebria dhe Greqia jan\u00eb shtete bregdetare n\u00eb krah t\u00eb nj\u00ebra-tjetr\u00ebs. Ndarja e hap\u00ebsirave detare p\u00ebrb\u00ebn nj\u00eb interes t\u00eb nd\u00ebrsjell\u00eb strategjik. P\u00ebrcaktimi i k\u00ebtyre hap\u00ebsirave p\u00ebr dy shtete q\u00eb jan\u00eb pjes\u00eb e Konvent\u00ebs t\u00eb s\u00eb Drejt\u00ebs s\u00eb Detit t\u00eb Montego Bay u mund\u00ebson atyre ushtrimin e sovranitetit t\u00eb plot\u00eb n\u00eb nj\u00eb zon\u00eb t\u00eb p\u00ebrcaktuar qart\u00eb me koordinata dhe shfryt\u00ebzimin e plot\u00eb t\u00eb burimeve natyrore.<\/li>\n<\/ol>\n<p>Sipas p\u00ebrcaktimeve t\u00eb Konvent\u00ebs, hap\u00ebsirat detare mes shteteve p\u00ebrb\u00ebhen nga tre komponent\u00eb kryesor\u00eb: a) Deti Territorial, hap\u00ebsira e uj\u00ebrave t\u00eb brendshme t\u00eb nj\u00eb shteti, q\u00eb shkojn\u00eb maksimumi deri n\u00eb 12 milje nga vija e drejt\u00eb baz\u00eb ose vija natyrale e ujit (Neni 3); b) Shelfi Kontinental, tabani i fundit i detit deri n\u00eb thell\u00ebsit\u00eb e shfryt\u00ebzimit teknik q\u00eb shtrihet deri n\u00eb 200 milje dhe kufiri i llogaritjes s\u00eb tij merret milja e 12-t\u00eb e kufirit t\u00eb detit territorial (Neni 76); c) Zona Ekskluzive Ekonomike, q\u00eb vendoset mbi Shelfin Kontinental, e cila shtrihet deri n\u00eb 200 milje dhe kufiri i llogaritjes s\u00eb saj merret milja e 12-t\u00eb e kufirit t\u00eb detit territorial. Zona Ekskluzive Ekonomike shtrihet nga tabani i detit deri n\u00eb sip\u00ebrfaqen e ujit (Neni 55). Zakonisht, Shelfi Kontinental dhe Zona Ekskluzive Ekonomike mbivendosen mbi nj\u00ebra-tjetr\u00ebn.<\/p>\n<p>N\u00eb baz\u00eb t\u00eb Konvent\u00ebs, hap\u00ebsirat detare midis shteteve p\u00ebrcaktohen me marr\u00ebveshje ose me vendim Gjykate dhe duhet t\u00eb pasqyrohen me koordinata gjeografike n\u00eb nj\u00eb hart\u00eb detare t\u00eb njohur nd\u00ebrkomb\u00ebtarisht. Marr\u00ebveshja duhet t\u00eb depozitohet n\u00eb Organizat\u00ebn e Kombeve t\u00eb Bashkuara. N\u00eb kund\u00ebrshtim me \u00e7far\u00eb pretendohet, Protokolli i Firences ka p\u00ebrcaktuar vet\u00ebm kufirin tok\u00ebsor mes Shqip\u00ebris\u00eb dhe Greqis\u00eb. Nd\u00ebrkoh\u00eb q\u00eb nga Piramida 79, q\u00eb konsiderohet edhe piramida ku takohet toka me detin, duhet ta ket\u00eb pik\u00ebnisjen vija e ardhshme delimituese detare mes dy shteteve tona. Por, deri m\u00eb sot, nuk ka nj\u00eb marr\u00ebveshje q\u00eb n\u00eb koordinata gjeografike t\u00eb p\u00ebrcaktoj\u00eb Detin Territorial, Shelfin Kontinental dhe Zon\u00ebn Ekskluzive Ekonomike.<\/p>\n<p>P\u00ebr kryerjen e delimitimit t\u00eb hap\u00ebsirave detare ka r\u00ebnd\u00ebsi q\u00eb shtetet t\u00eb p\u00ebrcaktojn\u00eb vij\u00ebn e drejt\u00eb baz\u00eb, e cila mund t\u00eb jet\u00eb normale, e drejt\u00eb ose e kombinuar, n\u00eb p\u00ebrputhje me Konvent\u00ebn, \u00e7ka m\u00eb pas ndihmon n\u00eb nd\u00ebrtimin e vij\u00ebs delimituese, s\u00eb cil\u00ebs i b\u00ebhen modifikime, duke marr\u00eb n\u00eb konsiderat\u00eb edhe elemente t\u00eb ve\u00e7anta, si\u00e7 jan\u00eb gjeografia e terrenit, titujt historik\u00eb dhe ndarja e drejt\u00eb. Prandaj, angazhimi n\u00eb k\u00ebt\u00eb proces \u00ebsht\u00eb i domosdosh\u00ebm. Madje, i vonuar. P\u00ebrfundimi i tij krijon mund\u00ebsi p\u00ebr shfryt\u00ebzimin e hap\u00ebsirave detare dhe burimeve natyrore.<\/p>\n<ol>\n<li>Nd\u00ebrkoh\u00eb q\u00eb nuk duhet t\u00eb ket\u00eb dyshime p\u00ebr nevojshm\u00ebrin\u00eb e k\u00ebtij procesi, \u00e7\u00ebshtja thelb\u00ebsore \u00ebsht\u00eb m\u00ebnyra sesi duhet t\u2019i qasemi atij. Vendimi i Gjykat\u00ebs Kushtetuese, i cili shpalli t\u00eb papajtueshme me Kushtetut\u00ebn marr\u00ebveshjen e n\u00ebnshkruar m\u00eb 27 prill 2009, p\u00ebrb\u00ebn nj\u00eb udh\u00ebrr\u00ebfyes q\u00eb duhet ndjekur me kujdes, pavar\u00ebsisht se nuk mungojn\u00eb z\u00ebrat publik\u00eb q\u00eb ende pretendojn\u00eb se kjo marr\u00ebveshje ishte e drejt\u00eb dhe se vendimmarrja e Gjykat\u00ebs Kushtetuese ishte e ndikuar politikisht.<\/li>\n<\/ol>\n<p>N\u00eb aspektin p\u00ebrmbajtjesor, tri elemente t\u00eb k\u00ebtij vendimi nuk duhen harruar: (i) Moszbatimi i parimeve baz\u00eb t\u00eb s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare p\u00ebr ndarjen e hap\u00ebsirave detare midis dy vendeve, me q\u00ebllim arritjen e nj\u00eb rezultati t\u00eb drejt\u00eb dhe t\u00eb ndersh\u00ebm. Th\u00ebn\u00eb ndryshe, aplikimi vet\u00ebm i parimit t\u00eb baraslarg\u00ebsis\u00eb strikte p\u00ebr t\u00eb gjitha hap\u00ebsirat dhe jo ai i baraslarg\u00ebsis\u00eb s\u00eb korrektuar, q\u00eb do t\u00eb \u00e7onte drejt nj\u00eb zgjidhjeje t\u00eb barabart\u00eb e t\u00eb ndershme; (ii) Mosmarrja parasysh e ishujve dhe konfigurimit gjeografik n\u00eb p\u00ebrgjith\u00ebsi si rrethana t\u00eb ve\u00e7anta n\u00eb delimitimin e hap\u00ebsirave detare; (iii) Papajtueshm\u00ebria mes p\u00ebrmbajtjes dhe titullit t\u00eb marr\u00ebveshjes, si dhe tejkalimi i s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare nga ana e Shqip\u00ebris\u00eb.<\/p>\n<p>Ata q\u00eb b\u00ebrtasin sot p\u00ebr efektin e 12 miljeve detare, b\u00ebjn\u00eb mir\u00eb t\u00eb kujtojn\u00eb se neni 2 i asaj marr\u00ebveshje q\u00eb kan\u00eb firmosur vet\u00eb njihte shprehimisht gjer\u00ebsin\u00eb e detit territorial t\u00eb Greqis\u00eb prej 12 miljesh detare, kur, n\u00eb fakt, kjo \u00e7\u00ebshtje s\u2019ka pse t\u00eb jet\u00eb objekt i marr\u00ebveshjeve, pasi \u00ebsht\u00eb \u00e7\u00ebshtje e brendshme e vet\u00eb shteteve, e cila rregullohet duke u bazuar n\u00eb Konvent\u00ebn e t\u00eb Drejt\u00ebs s\u00eb Detit.<\/p>\n<p>Po k\u00ebshtu, n\u00eb aspektin procedural nuk duhet t\u00eb harrojm\u00eb konkluzionet e vendimit t\u00eb Gjykat\u00ebs Kushtetuese p\u00ebr: (i) mospajisjen e grupit negociator me plotfuqi nga Presidenti i Republik\u00ebs p\u00ebr zhvillimin e negociatave dhe lidhjen e marr\u00ebveshjes; (ii) mosp\u00ebrcaktimin para nisjes s\u00eb procesit t\u00eb negocimit t\u00eb hap\u00ebsirave detare q\u00eb do t\u00eb ndaheshin; (iii) mosmarrjen parasysh t\u00eb marr\u00ebveshjeve t\u00eb m\u00ebparshme dypal\u00ebshe q\u00eb lidhen me kufijt\u00eb shtet\u00ebror\u00eb.<\/p>\n<p>Pas vendimit t\u00eb Gjykat\u00ebs Kushtetuese, qeveria e koh\u00ebs pajtoi nj\u00eb ekspertiz\u00eb nd\u00ebrkomb\u00ebtare. Ne, gjithashtu, ishim tejet t\u00eb ndjesh\u00ebm ndaj k\u00ebsaj \u00e7\u00ebshtje. N\u00eb opozit\u00eb kund\u00ebrshtuam n\u00eb Gjykat\u00ebn Kushtetuese marr\u00ebveshjen e vitit 2009. Nd\u00ebrsa me ardhjen n\u00eb krye t\u00eb pun\u00ebve t\u00eb vendit filluam nj\u00eb proces konsultimesh me ekspert\u00eb nd\u00ebrkomb\u00ebtar\u00eb dhe vend\u00ebs.<\/p>\n<p>T\u00eb gjitha ekspertizat arrit\u00ebn n\u00eb p\u00ebrfundimin se: (i) Delimitimi i vitit 2009 ishte rezultati m\u00eb minimal q\u00eb mund t\u00eb arrinte vendi yn\u00eb; (ii) Nevojitej nj\u00eb marr\u00ebveshje e re bazuar n\u00eb parimin e baraslarg\u00ebsis\u00eb me korrektim, p\u00ebr shkak t\u00eb konfiguracionit gjeografik; (iii) Aplikimi i parimit t\u00eb m\u00ebsip\u00ebrm do t\u00eb sillte p\u00ebrfitime n\u00eb hap\u00ebsirat detare t\u00eb Shqip\u00ebris\u00eb, nga t\u00eb cilat hap\u00ebsira n\u00eb Detin Territorial do t\u00eb ishte m\u00eb e favorshme, sepse n\u00eb k\u00ebt\u00eb hap\u00ebsir\u00eb detare ushtrohet sovranitet i plot\u00eb n\u00eb det, tabanin e detit dhe hap\u00ebsir\u00ebn ajrore mbi t\u00eb. Nd\u00ebrsa n\u00eb Shelfin Kontinental dhe Zon\u00ebn Ekskluzive Ekonomike, vendi yn\u00eb do t\u00eb p\u00ebrfitonte zgjerimin e t\u00eb drejtave sovrane.<\/p>\n<p>P\u00ebr ne socialist\u00ebt, vendimi i Gjykat\u00ebs Kushtetuese ishte jo vet\u00ebm udh\u00ebrr\u00ebfyesi q\u00eb duhet t\u00eb ndiqnim me kujdes, por n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb edhe linja e kuqe q\u00eb nuk duhet shkelur. Ndon\u00ebse n\u00eb kuptimin e Konvent\u00ebs s\u00eb Vjen\u00ebs mbi t\u00eb Drejt\u00ebn e Traktateve, marr\u00ebveshja e vitit 2009, p\u00ebr shkak t\u00eb mosratifikimit t\u00eb saj, nuk u konkludua, nuk ishte aspak e leht\u00eb p\u00ebr t\u2019u riulur n\u00eb tryez\u00ebn e diskutimeve e m\u00eb pas negocimit me Greqin\u00eb, me q\u00ebllim arritjen e nj\u00eb marr\u00ebveshje t\u00eb re.<\/p>\n<p>M\u00eb 14 tetor 2013, teksa mikprisja n\u00eb Tiran\u00eb homologun grek, Evangelos Venizelos, parashtrova n\u00eb takimin dypal\u00ebsh, e m\u00eb pas n\u00eb komunikimin publik, q\u00ebndrimin e qeveris\u00eb Rama jo vet\u00ebm p\u00ebr \u00e7\u00ebshtjen e detit, por edhe p\u00ebr t\u00eb gjitha \u00e7\u00ebshtjet e natyr\u00ebs historike mes dy vendeve tona, duke shprehur gatishm\u00ebrin\u00eb p\u00ebr adresimin e tyre bazuar n\u00eb parimet e themeluara t\u00eb s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare. T\u00eb nj\u00ebjtat q\u00ebndrime parashtrova edhe gjat\u00eb vizit\u00ebs n\u00eb Athin\u00eb, m\u00eb 6 shkurt 2014, n\u00eb takimet me Presidentin Karolos Papoulias, Kryeministrin Antonis Samaras dhe homologun Evangelos Venizelos. Parashtrimi i t\u00eb gjitha \u00e7\u00ebshtjeve n\u00eb m\u00ebnyr\u00eb sistematike e konsistente, ndon\u00ebse deri at\u00ebher\u00eb kishte munguar, \u00ebsht\u00eb gjithnj\u00eb m\u00eb i leht\u00eb sesa eksplorimi i zgjidhjeve t\u00eb pranueshme. K\u00ebshtu, takimi i kryeministrave Rama-Samaras, m\u00eb 4 shtator 2014, n\u00eb kuad\u00ebr t\u00eb samitit t\u00eb NATO-s n\u00eb Wales, nxiti kalimin nga faza e identifikimit dhe parashtrimit t\u00eb problematikave dypal\u00ebshe, te p\u00ebrcaktimi i nj\u00eb kuadri p\u00ebr adresimin e tyre.<\/p>\n<p>P\u00ebr k\u00ebt\u00eb q\u00ebllim, fillimisht nis\u00ebm diskutimet eksploratore n\u00eb nivel diplomatik dhe teknik. M\u00eb pas, me ardhjen e qeveris\u00eb Tsipras n\u00eb Greqi, nga diskutimet eksploratore kaluam te shk\u00ebmbimi q\u00ebndrimeve n\u00eb form\u00eb shkresore p\u00ebr \u00e7\u00ebshtjet e pazgjidhura mes nesh. \u00c7\u00ebshtje q\u00eb rrokin nj\u00eb problematik\u00eb 80-vje\u00e7are, nga vendosja e ligjit t\u00eb luft\u00ebs nga ana e Greqis\u00eb ndaj Shqip\u00ebris\u00eb, e deri tek ato t\u00eb aktualitetit. Me homologun Kotzias ngrit\u00ebm nj\u00eb mekaniz\u00ebm t\u00eb p\u00ebrhersh\u00ebm dypal\u00ebsh n\u00eb nivel diplomatik, q\u00eb i parapriu dialogut politik n\u00eb nivelin e ministrave t\u00eb Jasht\u00ebm dhe m\u00eb pas t\u00eb kryeministrave.<\/p>\n<p>Shkurt, nd\u00ebrtuam nj\u00eb proces besimi hap pas hapi, duke analizuar bisedimet, interesat e nd\u00ebrsjella, instrumentet n\u00eb dispozicionin ton\u00eb dhe skicuam rrug\u00ebn e kalendarin p\u00ebr m\u00ebnyr\u00ebn e zgjidhjeve t\u00eb t\u00eb gjitha \u00e7\u00ebshtjeve dypal\u00ebshe, duke p\u00ebrfshir\u00eb edhe delimitimin e hap\u00ebsirave detare, me synim nj\u00eb ndarje t\u00eb drejt\u00eb e t\u00eb ndershme mes pal\u00ebve.<\/p>\n<p>Negocimi i marr\u00ebveshjes s\u00eb re p\u00ebr delimitimin e hap\u00ebsirave detare, q\u00eb pasoi procesin e p\u00ebrshkruar m\u00eb lart, u bazua n\u00eb ligjin 43\/2016 \u201cP\u00ebr Marr\u00ebveshjet Nd\u00ebrkomb\u00ebtare n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb\u201d. Ligj, i cili n\u00eb vetvete reflektonte vendimin e Gjykat\u00ebs Kushtetuese n\u00eb raport me m\u00ebnyr\u00ebn e nd\u00ebrveprimit t\u00eb institucioneve shqiptare dhe tagrin e tyre t\u00eb p\u00ebrfaq\u00ebsimit n\u00eb nj\u00eb negocim t\u00eb till\u00eb. Grupi negociator, n\u00eb p\u00ebrb\u00ebrje t\u00eb t\u00eb cilit kishte p\u00ebrfaq\u00ebsues t\u00eb 11 institucioneve shtet\u00ebrore dhe akademike, zhvilloi tri raunde bisedimesh me pal\u00ebn greke.<\/p>\n<p>P\u00ebrgjat\u00eb k\u00ebtij procesi disavje\u00e7ar q\u00eb p\u00ebrfshin institucionet kryesore t\u00eb vendit, Ministria p\u00ebr Europ\u00ebn dhe Pun\u00ebt e Jashtme ka p\u00ebrgatitur nj\u00eb dosje voluminoze rreth 1200 faqe, me materiale studimore, arkivore, ligjore, hartografike, fotografike, arkeologjike, minerale, hidrokarbure, navigacionale e t\u00eb tjera.<\/p>\n<p>Ky angazhim serioz me Greqin\u00eb mb\u00ebshtetej nga partner\u00ebt tan\u00eb strategjik\u00eb, t\u00eb cil\u00ebt mbaheshin t\u00eb informuar p\u00ebr paket\u00ebn e \u00e7\u00ebshtjeve n\u00eb diskutim dhe inkurajonin gjetjen e zgjidhjeve t\u00eb q\u00ebndrueshme mes pal\u00ebve. Gjithashtu, duhet theksuar fakti se gjat\u00eb k\u00ebsaj periudhe, Greqia ishte e angazhuar edhe n\u00eb nj\u00eb front tjet\u00ebr diplomatik me Maqedonin\u00eb e Veriut, q\u00eb u kuror\u00ebzua me Marr\u00ebveshjen e Presp\u00ebs.<\/p>\n<p>Nd\u00ebrsa ne arrit\u00ebm t\u00eb p\u00ebrmbyllnim disa prej \u00e7\u00ebshtjeve t\u00eb paket\u00ebs. Zgjidh\u00ebm \u00e7\u00ebshtjen e toponimeve, duke eliminuar pengesat n\u00eb l\u00ebvizjet nd\u00ebrkufitare t\u00eb shtetasve tan\u00eb. Greqia hoqi rezerv\u00ebn p\u00ebr p\u00ebrdorimin e vul\u00ebs apostile, duke i kursyer xhepave t\u00eb shtetasve tan\u00eb rreth 5 milion\u00eb euro n\u00eb vit p\u00ebr dokumente t\u00eb ndryshme. Heqja e rezerv\u00ebs p\u00ebr vul\u00ebn apostile i hap rrug\u00eb dhe l\u00ebshimit t\u00eb certifikatave nga zyrat tona konsullore n\u00eb Greqi, \u00e7ka do t\u00eb p\u00ebrb\u00ebnte nj\u00eb leht\u00ebsim t\u00eb madh p\u00ebr shtetasit tan\u00eb.<\/p>\n<p>Rreth 150 mij\u00eb shtetas shqiptar\u00eb p\u00ebrfituan nga zgjidhja e problematik\u00ebs s\u00eb regjistrimit t\u00eb f\u00ebmij\u00ebve t\u00eb lindur n\u00eb Greqi nga nj\u00eb ose t\u00eb dy prind\u00ebrit q\u00eb nuk kan\u00eb leje q\u00ebndrimi n\u00eb Greqi. U njoh\u00ebn lejet e drejtimit t\u00eb automjeteve. Rreth 800 euro u kushtonte shtetasve shqiptar\u00eb n\u00eb Greqi procedura e njohjes s\u00eb patent\u00ebs. Rinis\u00ebm pun\u00ebn p\u00ebr rishikimin e teksteve shkollore, bazuar mbi marr\u00ebveshjen e vitit 1998, duke shk\u00ebmbyer raporte mbi gjetjet n\u00eb tekstet respektive p\u00ebr \u00e7\u00ebshtjet q\u00eb p\u00ebrb\u00ebjn\u00eb shqet\u00ebsim p\u00ebr secil\u00ebn pal\u00eb.<\/p>\n<p>P\u00ebr zbatimin n\u00eb terren t\u00eb marr\u00ebveshjes s\u00eb vitit 2009, mbi k\u00ebrkimin, zhvarrimin, identifikimin dhe rivarrimin e ushtar\u00ebve grek\u00eb t\u00eb r\u00ebn\u00eb n\u00eb Shqip\u00ebri, gjat\u00eb Luft\u00ebs ItaloGreke t\u00eb vitit 1940-1941 dhe nd\u00ebrtimin e vendprehjes p\u00ebr ta n\u00eb territorin e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb u miratuan disa protokolle teknike me q\u00ebllim: (i) sakt\u00ebsimin e numrit t\u00eb t\u00eb r\u00ebn\u00ebve grek\u00eb; (ii) sakt\u00ebsimin e zonave ku duhet t\u00eb kryhen g\u00ebrmimet; (iii) m\u00ebnyr\u00ebn e identifikimit t\u00eb t\u00eb r\u00ebn\u00ebve; (iv) sigurimin e prezenc\u00ebs s\u00eb t\u00eb gjitha institucioneve p\u00ebrkat\u00ebse gjat\u00eb procesit t\u00eb zhvarrimit dhe e dokumentacionit shoq\u00ebrues t\u00eb procesit.<\/p>\n<p>III. Ndryshimet politike n\u00eb Greqi n\u00eb mesin e vitit 2019 risoll\u00ebn n\u00eb qeverisje Nea Demokracin\u00eb, e cila ishte n\u00eb qeverisje gjat\u00eb n\u00ebnshkrimit t\u00eb marr\u00ebveshjes me Shqip\u00ebrin\u00eb, n\u00eb vitin 2009. Nuk duhet t\u00eb harrojm\u00eb se p\u00ebr Nea Demokracin\u00eb, marr\u00ebveshja e vitit 2009 konsiderohej si arritja m\u00eb e madhe strategjike e Greqis\u00eb n\u00eb politik\u00ebn e jashtme.<\/p>\n<p>Ky ndryshim politik n\u00eb Greqi u shoq\u00ebrua me nj\u00eb qasje t\u00eb ndryshme mbi paket\u00ebn e \u00e7\u00ebshtjeve t\u00eb pazgjidhura mes dy shteteve tona, p\u00ebr m\u00ebnyr\u00ebn sesi u ve\u00e7ua nga paketa dhe sesi do t\u00eb adresohet \u00e7\u00ebshtja e delimitimit t\u00eb hap\u00ebsirave detare. P\u00ebr shembull, paketa p\u00ebrmbante edhe trajtimin e marr\u00ebveshjeve p\u00ebr administrimin e piramidave dhe shenjave kufitare si dhe at\u00eb t\u00eb bashk\u00ebpunimit nd\u00ebrkufitar. Ndon\u00ebse jo t\u00eb lidhura n\u00eb kuptimin ligjor t\u00eb fjal\u00ebs, p\u00ebrfundimi i k\u00ebtyre marr\u00ebveshjeve, paralelisht me at\u00eb t\u00eb delimitimit t\u00eb hap\u00ebsirave detare, mbyll p\u00ebrfundimisht \u00e7\u00ebshtjet kufitare mes Shqip\u00ebris\u00eb dhe Greqis\u00eb, e nj\u00ebkoh\u00ebsisht varros \u00e7do pretendim t\u00eb qarqeve ekstremiste greke p\u00ebr t\u00eb ashtuquajturin Vorio Epir.<\/p>\n<p>I dhimbsh\u00ebm \u00ebsht\u00eb fakti se pavar\u00ebsisht p\u00ebrpjekjeve disavje\u00e7are q\u00eb \u00e7\u00ebshtja e delimitimit t\u00eb hap\u00ebsir\u00ebs detare t\u00eb mbetej n\u00eb nivel dypal\u00ebsh, p\u00ebr her\u00eb t\u00eb par\u00eb, m\u00ebnyra e zgjidhjes s\u00eb k\u00ebsaj \u00e7\u00ebshtje dypal\u00ebshe p\u00ebrfshihet n\u00eb projektdokumentin e Kuadrit Negociues, q\u00eb do t\u00eb udh\u00ebheq\u00eb procesin e bisedimeve t\u00eb an\u00ebtar\u00ebsimit t\u00eb Shqip\u00ebris\u00eb n\u00eb Bashkimin Europian. Megjith\u00ebse BE-ja ka n\u00eb gjirin e saj shtete an\u00ebtare, t\u00eb cilat ende nuk kan\u00eb gjetur rrug\u00ebn e zgjidhjes me nj\u00ebra-tjetr\u00ebn p\u00ebr \u00e7\u00ebshtjet e delimitimit t\u00eb hap\u00ebsirave detare, p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb nj\u00eb standardi europian, insistimi i Greqis\u00eb p\u00ebr ta b\u00ebr\u00eb k\u00ebt\u00eb \u00e7\u00ebshtje dypal\u00ebshe, q\u00eb zgjidhet vet\u00ebm p\u00ebrmes s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare, pjes\u00eb t\u00eb axhend\u00ebs europiane, shton n\u00eb m\u00ebnyr\u00eb t\u00eb padrejt\u00eb presionin ndaj nesh.<\/p>\n<ol>\n<li>Sot jemi p\u00ebrball\u00eb faktit t\u00eb deklaruar se Shqip\u00ebria dhe Greqia do t\u2019i drejtohen nj\u00eb Gjykate nd\u00ebrkomb\u00ebtare p\u00ebr delimitimin e hap\u00ebsirave detare. Ky \u00ebsht\u00eb gjithashtu nj\u00eb proces impenjativ, q\u00eb k\u00ebrkon dije, p\u00ebrgatitje serioze dhe koh\u00ebn e duhur, pasi nuk kemi t\u00eb b\u00ebjm\u00eb me transferim t\u00eb p\u00ebrgjegj\u00ebsive p\u00ebr m\u00ebnyr\u00ebn e adresimit t\u00eb k\u00ebsaj \u00e7\u00ebshtje, por me shprehjen e gatishm\u00ebris\u00eb t\u00eb pal\u00ebve nd\u00ebrgjyq\u00ebse p\u00ebr t\u00eb pranuar verdiktin e Gjykat\u00ebs nd\u00ebrkomb\u00ebtare.<\/li>\n<li>N\u00eb thelb, ky proces p\u00ebrgatitet nga pal\u00ebt, nd\u00ebrkoh\u00eb q\u00eb vendimmarrja \u00ebsht\u00eb e Gjykat\u00ebs. N\u00eb negociatat dypal\u00ebshe, pal\u00ebt veprojn\u00eb mbi baz\u00ebn e objektivave dhe ekzigjencave t\u00eb tyre. Ato kontrollojn\u00eb produktin e negociat\u00ebs. Kur pal\u00ebt vendosin t\u2019i drejtohen Gjykat\u00ebs, kjo e fundit \u00ebsht\u00eb rojtare e precedent\u00ebve t\u00eb vendosur nga e drejta nd\u00ebrkomb\u00ebtare. Rrjedhimisht, e pandjeshme ndaj objektivave t\u00eb pal\u00ebve.<\/li>\n<\/ol>\n<p>Para nisjes s\u00eb procesit gjyq\u00ebsor, Shqip\u00ebria dhe Greqia do t\u00eb duhet t\u00eb p\u00ebrfshihen s\u00ebrish n\u00eb nj\u00eb proces nd\u00ebrveprues, nga i cili duhet t\u00eb hartojn\u00eb nj\u00eb dokument t\u00eb p\u00ebrbashk\u00ebt p\u00ebr l\u00ebnd\u00ebn q\u00eb do t\u2019i n\u00ebnshtrohet gjykimit, ku duhet t\u00eb evidentohen gjithashtu pikat e p\u00ebrbashk\u00ebta dhe diferencat mes pal\u00ebve, p\u00ebr t\u00eb cilat duhet t\u00eb shprehet Gjykata.<\/p>\n<p>Pal\u00ebt i paraprijn\u00eb k\u00ebtij procesi, duke fortifikuar pozicionin e tyre ligjor, q\u00eb i ndihmon ato n\u00eb ballafaqimin gjyq\u00ebsor me t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare. N\u00eb drit\u00ebn e k\u00ebtij zhvillimi duhet lexuar edhe Dekreti Nr. 107, i dat\u00ebs 25 dhjetor 2020, i Presidentes Greke \u201cP\u00ebr mbylljen e gjireve dhe nd\u00ebrtimin e vij\u00ebs s\u00eb drejt\u00eb baz\u00eb n\u00eb zon\u00ebn detare t\u00eb ishujve Jon deri n\u00eb Peloponez\u201d. Shpreh bindjen se institucionet e shtetit shqiptar duhet ta ken\u00eb analizuar p\u00ebrmbajtjen e dekretit dhe verifikuar koordinatat detare, p\u00ebr t\u2019u siguruar se nj\u00eb akt i till\u00eb \u00ebsht\u00eb n\u00eb p\u00ebrputhje me t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare dhe nuk cenon sigurin\u00eb ton\u00eb komb\u00ebtare. E n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, t\u00eb punojn\u00eb p\u00ebr strategjin\u00eb dhe hapat q\u00eb duhen ndjekur p\u00ebr procesin gjyq\u00ebsor.<\/p>\n<p>Sipas Gjykat\u00ebs Nd\u00ebrkomb\u00ebtare t\u00eb Drejt\u00ebsis\u00eb, procesi i delimitimit t\u00eb hap\u00ebsirave detare ndjek k\u00ebt\u00eb procedur\u00eb: (i) Prezantimi dhe analizimi i baz\u00ebs ligjore nd\u00ebrkomb\u00ebtare dhe t\u00eb brendshme t\u00eb pal\u00ebve; (ii) Analizimi i gjeografis\u00eb s\u00eb terrenit n\u00eb hap\u00ebsir\u00ebn detare ku do t\u00eb kryhet delimitimi dhe p\u00ebrcaktimi i pikave baz\u00eb nga do t\u00eb filloj\u00eb nd\u00ebrtimi i vij\u00ebs delimituese; (iii) Nd\u00ebrtimi i nj\u00eb vij\u00eb delimituese provizore, \u00e7do pik\u00eb e s\u00eb cil\u00ebs \u00ebsht\u00eb e baraslarguar nga pikat baz\u00eb n\u00eb bregdetin respektiv t\u00eb pal\u00ebve;<\/p>\n<p>(iv) Pas nd\u00ebrtimit t\u00eb vij\u00ebs delimituese provizore b\u00ebhet korrektimi i k\u00ebsaj vije p\u00ebr n\u00eb Detin Territorial, p\u00ebr rrethana t\u00eb ve\u00e7anta (roli dhe pesha e shk\u00ebmbinjve, cek\u00ebtinave, instalimet detare) dhe tituj historik\u00eb (hap\u00ebsirat detare t\u00eb shpallura dhe t\u00eb njohura si t\u00eb tilla), p\u00ebr n\u00eb Shelfin Kontinental dhe Zon\u00ebn Eksluzive Ekonomike, p\u00ebr nj\u00eb ndarje t\u00eb drejt\u00eb (p\u00ebr shkak t\u00eb gjeografis\u00eb ishujt marrin m\u00eb pak pesh\u00eb n\u00eb delimitim p\u00ebrball\u00eb tok\u00ebs kontinentale).<\/p>\n<p>N\u00eb fund t\u00eb k\u00ebtij procesi prodhohet nj\u00eb hart\u00eb detare me koordinata t\u00eb vij\u00ebs delimituese mes pal\u00ebve.<\/p>\n<p>Jo m\u00eb pak e r\u00ebnd\u00ebsishme \u00ebsht\u00eb edhe vendimmarrja p\u00ebr p\u00ebrzgjedhjen e Gjykat\u00ebs Nd\u00ebrkomb\u00ebtare, q\u00eb do t\u00eb shqyrtoj\u00eb \u00e7\u00ebshtjen e delimitimit t\u00eb hap\u00ebsirave detare dhe organizimin shtet\u00ebror p\u00ebr k\u00ebt\u00eb proces. E drejta nd\u00ebrkomb\u00ebtare njeh t\u00eb pakt\u00ebn tri institucione ku mund t\u00eb referohet \u00e7\u00ebshtja: (i) Gjykata Nd\u00ebrkomb\u00ebtare e Drejt\u00ebsis\u00eb, si rojtarja kryesore e s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare, e cila ka nj\u00eb eksperienc\u00eb t\u00eb konsiderueshme n\u00eb zgjidhjen e k\u00ebtyre \u00e7\u00ebshtjeve; (ii) Tribunali Nd\u00ebrkomb\u00ebtar p\u00ebr t\u00eb Drejt\u00ebn e Detit, veprimtaria e t\u00eb cilit bazohet n\u00eb Konvent\u00ebn Nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb Drejt\u00ebn e Detit, por me nj\u00eb eksperienc\u00eb m\u00eb modeste krahasuar me Gjykat\u00ebn Nd\u00ebrkomb\u00ebtare t\u00eb Drejt\u00ebsis\u00eb; (iii) Gjykata Permanente e Arbitrazhit, ndon\u00ebse ky arbitrazh nuk g\u00ebzon statusin ligjor t\u00eb zgjidhjes si Gjykata Nd\u00ebrkomb\u00ebtare e Drejt\u00ebsis\u00eb.<\/p>\n<p>Vendi yn\u00eb ka qen\u00eb vet\u00ebm nj\u00eb her\u00eb pal\u00eb nd\u00ebrgjyq\u00ebse n\u00eb Gjykat\u00ebn Nd\u00ebrkomb\u00ebtare t\u00eb Drejt\u00ebsis\u00eb p\u00ebr incidentin e Kanalit t\u00eb Korfuzit. Nd\u00ebrkoh\u00eb q\u00eb nuk ka nj\u00eb praktik\u00eb me dy institucionet e tjera.<\/p>\n<ol>\n<li>Duke u nisur nga sa m\u00eb sip\u00ebr, \u00ebsht\u00eb rasti t\u00eb ritheksoj se ushtrimi i politik\u00ebs s\u00eb jashtme k\u00ebrkon disiplin\u00eb strategjike. Greqia \u00ebsht\u00eb nj\u00eb partner strategjik n\u00eb rajon, me t\u00eb cilin kemi ende \u00e7\u00ebshtje t\u00eb r\u00ebnd\u00ebsishme t\u00eb pazgjidhura, p\u00ebrfshir\u00eb edhe delimitimin e hap\u00ebsirave detare. Kjo nuk do t\u00eb thot\u00eb se duhet ta shohim at\u00eb me paranoj\u00eb e as me inferioritet. Loj\u00ebrat politike dhe akuzat duhet t\u2019i l\u00ebn\u00eb vendin nj\u00eb diskutimi serioz, q\u00eb udh\u00ebhiqet nga arsyeja shtet\u00ebrore dhe interesi komb\u00ebtar, e q\u00eb siguron n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb mir\u00ebkuptim sa m\u00eb t\u00eb gjer\u00eb politik e shoq\u00ebror, p\u00ebr trajtimin e \u00e7\u00ebshtjeve t\u00eb pazgjidhura me fqinjin sipas objektivave t\u00eb p\u00ebrcaktuara nga politika e jashtme.<\/li>\n<\/ol>\n<p>Ne kemi arritur t\u2019i vendosim n\u00eb tryez\u00ebn e bisedimeve t\u00eb gjitha \u00e7\u00ebshtjet dypal\u00ebshe.
